Liability Orders & Summons

Councils are committing fraud by unlawfully issuing their own court summons and liability orders. Shockingly, they even hire the courts and use their own judges, creating a blatant conflict of interest.

However, the Local Government Act 1888, Section 78(2), clearly states that this practice is illegal. The Act specifies that no county council, committee, or member thereof is authorized to:

​

(a) Exercise any powers of a court of record
(b) Administer an oath
(c) Exercise jurisdiction under the Summary Jurisdiction Acts, perform judicial business, or act as justices of the peace

Furthermore, bailiffs and enforcement agents rely on liability orders that no longer exist. According to The Council Tax Handbook, Chapter 10, the form (Form A) used for liability orders was removed from law on 10 July 2003 in Wales and 1 October 2003 in England, with no replacement issued. Additionally, court orders may be invalid if no written record exists. Notably, all paperwork states “You” owe money or are summoned. Legally, “You” refers to a company or legal entity—not an individual—making this wording misleading.
